The Annex Privacy Policy

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from The Annex (the “Business”).

Personal Information We Collect

When you make a purchase or attempt to make a purchase from the Business, we collect certain information from you, including your name, size information, billing address, shipping address, payment information (including credit card numbers and the relevant information required for PayPal payment), email address, and phone number.  We refer to this information as “Order Information.” 

How Do We Use Your Personal Information?

We use the Order Information that we collect generally to fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:

Communicate with you;

Screen our orders for potential risk or fraud; and

Create your custom items using the data you have provided.

 Sharing Your Personal Information

Your personal information will not be shared with any third parties, however, we may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Your Rights

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfil contracts we might have with you (for example if you make an order from the Business), or otherwise to pursue our legitimate business interests listed above. 

Data Retention

When you place an order from the Business, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Changes

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

These Terms and Conditions explain the rights you as a customer are entitled to. Please read these very carefully. You may have other rights granted by law and our Terms and Conditions do not affect these in any way

The following terms and conditions apply to all transactions with The Annex. The placement of an order indicates your acceptance of these terms and conditions. Please read them carefully and feel free to print a copy for future reference should you wish to. They are in compliance with Consumer Contract Rules and Regulations 2014. These terms and conditions do not affect your statutory rights. To order goods you must be at least 16 years of age and accept delivery within the UK.

Description of Goods

All images, descriptive matter, specifications and advertising online is, as accurate a description of the goods, that is possible within a website/social media page.

Photos may be those of the stock or examples of previous designs, therefore may not be an exact indication of the item you will be receiving. Photos of custom orders will be sent for approval before posting.

Prices

The Annex reserves the right to change the price list at any time. If pricing mistakes have been made these will be taken into consideration when orders are placed, and the correct amounts will be charged. 

Accuracy of Product Information

The Annex strives to ensure that all information on the website/social media pages should be as accurate and up to date as possible. However, we cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual.

Payment and Price

The Annex is entitled to make adjustments to the price due to an error or omission or if the price published for the goods is wrong, whether or not the order has been confirmed. Customers will be informed of the correct price and given the opportunity to cancel the order. All prices are inclusive of VAT. No orders will be confirmed and started until full payment is made. Deposits and payment plans are available by prior arrangement,

Typographical Errors

In the event a product is listed at an incorrect price due to typographical error, taxes or duty changes, The Annex have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed.

 

Payment Methods

We use the following payment methodsSumup bank transfer, Sumup payment link, Paypal, cash and all major credit and debit cards including Visa, Master Card and Switch. Your order will only be processed once your payment has been properly received.

Availability of Goods

All products and services are subject to availability and may be withdrawn at any time

Turnaround

Current turnaround is 4 weeks from order to posting, however, this is subject to change. If this does change, future customers shall be informed.

Delivery

Postage is calculated by weight. Tracked/signed for postage is used. Paid upgrades are available. Delivery to mainland Shetland is free for any order, as is click and collect from Gulberwick. Postage is only currently available to the UK, however, we will be looking into worldwide postage. Please bare in mind that we are based in Shetland, therefore postage may take a little longer.

The Annex aims to deliver goods within the times stated online but goods are subject to availability and delay in delivery of goods is sometimes beyond our control. Any dates specified for the delivery of the goods are approximate only and The Annex shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods. If there are any delays, the customer will be kept informed. If an item has not been started within 14 days of purchase the customer has a right to cancel their order and receive a full refund.

Claims/Refunds/Returns

If goods arrive in a damaged condition it is the customer’s responsibility to inform The Annex within 14 days from delivery. This will include sending photographic evidence.

If anything is missing it is the customer’s responsibility to inform The Annex within 14 days from delivery.

It is the customer’s responsibility to inform The Annex of any incorrect goods supplied within 14 days from delivery. Mistakes made on the customer’s part will not be refunded or replaced. Mistakes made by The Annex will either be refunded or replaced.

The Annex cannot accept liability for goods lost in transit unless notified within 14 days from the expected delivery date. If in the unlikely event it appears that the goods have been lost in the post, The Annex will replace these.

Our custom orders are created using the information that you have provided, so please ensure that you have checked the information such as size, style and colour before ordering. Please also check the delivery address provided when paying, as items will only be sent to the address provided on Paypal etc.

Should you wish to cancel your order, please contact The Annex as soon as possible. It is at the discretion of The Annex as to whether a refund is possible. If we have not yet begun making your order, we may be able to refund – however this is not always possible.

If you are not totally satisfied with your purchase for any reason, you have the right to return your order within 14 working days of receipt. It is your responsibility to return any such items in a pristine saleable condition in suitably protective packaging. You will be wholly responsible for the return of the goods and any associated costs of return in the case of a change of mind or size. Goods received back incomplete, damaged or in any condition other than saleable, will not be refunded or exchanged. If you wish to return any products, please contact The Annex within 14 days from the date of delivery. If goods are not returned within 14 days after you have informed The Annex that you wish to return your order, your right to return will be revoked.
